Privacy Policy
Effective Date: September 15, 2026PharmSurance ("we," "us," or "our") is committed to protecting the privacy and security of your personal information. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit our website or interact with our services. Please read this policy carefully.
1. Information We Collect
We may collect the following types of personal information:
- Contact Information: Name, phone number, email address, and state of residence
- Communication Preferences: Preferred time of contact
- Inquiry Information: Questions or messages you submit through our forms
- Consent Records (Technical Information): When you interact with a form on this site, we record your IP address and a timestamp alongside the exact consent language you agreed to — captured separately for general contact consent and, if you opt in, for text-message consent. We use a third-party service (ipify) to determine your IP address. This record exists so we can demonstrate that you gave us permission to contact you, and is retained as required by CMS and applicable state and federal law.
We do not collect Social Security numbers, financial account information, or detailed medical or health records through this website. Please do not include health information, diagnoses, or a list of your medications in a website form — your advisor will collect anything clinically relevant directly and securely.
2. How We Use Your Information
We use the information we collect for the following purposes:
- To connect you with a licensed PharmSurance insurance advisor in your area
- To respond to your inquiries and provide requested information
- To send you text messages about your inquiry, including connecting you with your assigned advisor, if you have separately opted in to receive them
- To send you the PharmSurance newsletter if you have opted in to receive it
- To improve our website and services
- To comply with applicable laws and regulations, including CMS Medicare marketing guidelines
3. CMS Medicare Marketing Compliance
PharmSurance advisors are fully licensed and may offer Medicare Advantage, Medicare Supplement, and Medicare Part D prescription drug plans. In accordance with the Centers for Medicare & Medicaid Services (CMS) Medicare Communications and Marketing Guidelines, we adhere to the following standards:
- We will not contact you by phone, text, or electronic direct message unless you have given us permission to do so — for example, by submitting a form on this site, returning a business reply card, or asking us to reach out
- We will not engage in high-pressure sales tactics or misleading communications
- A Scope of Appointment will be documented and agreed to before any personal marketing appointment about Medicare Advantage, Prescription Drug, or Cost plans
- We do not offer gifts, payments, or other inducements to influence your Medicare plan selection
- We do not market non-health products — such as life insurance or annuities — during a Medicare appointment. Those conversations happen in a separate, dedicated appointment
- Sales and marketing calls with beneficiaries are recorded in their entirety, as CMS requires of independent agents and brokers
- We display the CMS-required disclaimer stating that we do not offer every plan available in your area, that any information we provide is limited to the plans we do offer, and directing you to Medicare.gov or 1-800-MEDICARE to get information on all of your options
- Text messages are sent only if you separately and affirmatively opt in — this consent is never required to use our services, and you may opt out at any time by replying STOP
PharmSurance is not affiliated with, endorsed by, or connected to the United States government, the federal Medicare program, or the Centers for Medicare & Medicaid Services.
4. How We Share Your Information
We do not sell, rent, or trade your personal information to third parties. We may share your information in the following limited circumstances:
- How we connect you with an advisor: When your inquiry relates to Medicare options, PharmSurance may contact you first to identify a single licensed advisor in our network, suited to your needs and licensed in your state — and will get your agreement before sharing your full information with that specific advisor. We do not distribute your information to multiple advisors, and we do not resell or re-market it to other agencies or lead buyers.
- Service providers: We use third-party providers to operate this website and process form submissions (currently Formspree for form delivery and ipify for IP lookup). They process your information on our behalf, subject to their terms and our instructions.
- Legal compliance: We may disclose information as required by law or in response to valid legal process
5. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
6. Your Rights and Choices
You have the following rights regarding your personal information:
- Opt-Out: You may opt out of receiving our newsletter at any time by contacting us or using the unsubscribe link in any email communication
- Text Opt-Out: If you opted in to text messages, you may opt out at any time by replying STOP, without affecting any other part of your relationship with us
- Do Not Contact: You may request that we not contact you regarding Medicare insurance products at any time, by any method, and we will honor it
- Access and Correction: You may request access to or correction of the personal information we hold about you, including your consent record, by contacting us directly
7. Cookies and Website Analytics
Our website may use cookies and similar tracking technologies to improve your browsing experience and analyze website traffic. You may adjust your browser settings to refuse cookies; however, some features of the website may not function properly as a result.
